Unplug OS Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Unplug OS ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Nicole Kelner LLC DBA Mindful Tech Studio ("we," "us," or "our").

2. Description of Service

Unplug OS is a mobile application designed to help users manage their phone usage. Distracting apps stay blocked by default, and you use a temporary access session when you intentionally want to use them. The App provides:

  • Blocking mode: an always-on blocking state for the apps you select
  • Temporary access sessions: time-limited access to blocked apps
  • Optional mindfulness activities and puzzles (such as math, box breathing, and gratitude prompts) to start a temporary access session
  • Scheduling and automation tools
  • Optional QR codes that start or end blocking mode
  • Optional location-based activation: automatically start blocking mode when you arrive at a saved place (such as home)
  • Session status via notifications, Live Activities, and the Dynamic Island

The App uses Apple's Screen Time API to enable blocking functionality.

3. Account Registration

To use the App, you must:

  • Be at least 16 years of age
  • Create an account using Apple Sign In
  • Provide accurate and complete information
  • Maintain the security of your account credentials

You are responsible for all activities that occur under your account.

4. Age Requirement

You must be at least 16 years of age to use Unplug OS. By using the app, you represent that you are at least 16 years old.

5. Subscription Terms

5.1 Free and Pro Tiers

Free Tier: Provides access to core blocking with limited features.

Pro Tier: Unlocks unlimited app blocking and additional features through an auto-renewable subscription.

5.2 Subscription Details

Payment: Subscriptions are charged to your Apple ID account upon purchase confirmation.

Free Trial: Where offered, a free trial automatically converts to a paid subscription unless canceled at least 24 hours before the trial ends.

Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

Pricing: Subscription prices are displayed in the App and may vary by region.

Cancellation: You can cancel your subscription anytime through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.

5.3 Refunds

All purchases are processed through Apple's App Store. Refund requests must be submitted to Apple according to their refund policy. We do not have access to process refunds directly.

5.4 Downgrade to Free Tier

If your Pro subscription ends or is canceled, you will be downgraded to the Free tier and Pro features will no longer be available. Your account and settings are retained, but the Free tier's limits will apply.

6. User Responsibilities

You agree to:

  • Use the App only for lawful purposes
  • Not attempt to bypass, disable, or circumvent the App's blocking features
  • Not reverse engineer, decompile, or disassemble the App
  • Not use the App in any way that could harm, disable, or impair the service
  • Comply with all applicable laws and regulations

7. Screen Time Permissions

The App requires Screen Time permissions to function. By granting these permissions, you understand that:

  • The App will block access to apps you designate while blocking mode is active
  • You may need to solve puzzles or complete activities to start a temporary access session and access blocked apps
  • You can revoke permissions at any time through iOS Settings, which will disable the App's blocking functionality

8. Location, Notifications, and Other Permissions

Some features use additional, optional iOS permissions:

  • Location (While Using the App): Used only to detect arrival at your saved places to automatically start blocking mode. Location data is processed on your device and is not transmitted to our servers.
  • Notifications and Live Activities: Used to show session status, reminders, and re-blocking alerts.
  • Camera: Used only to scan QR codes that trigger blocking mode.

You can decline or revoke any of these permissions in iOS Settings; the related features will be unavailable, but the rest of the App will continue to work.

9. QR Codes

Unplug OS allows you to use QR codes as physical triggers to start or end blocking mode. By using this feature, you agree to the following:

  • QR codes must be set up using the app before use
  • You agree to use QR codes only for their intended purpose of managing your own app blocking
  • You are responsible for the physical security and placement of your printed QR codes
  • Do not set up QR codes to be used by others without their consent

10. Intellectual Property

The App, including its design, code, content, and features, is owned by Nicole Kelner LLC and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You may not:

  • Copy, modify, or create derivative works of the App
  • Distribute, sell, or lease the App
  • Remove or alter any proprietary notices

11. Privacy

Your use of the App is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

12. Disclaimers and Limitations of Liability

12.1 No Warranty

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE FROM HARMFUL COMPONENTS.

12.2 Not Medical or Professional Advice

The App is designed for general wellness and productivity purposes. It is not a substitute for professional medical, therapeutic, or counseling services. If you have concerns about phone addiction or mental health, please consult a qualified professional.

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • We suspect fraudulent or illegal activity
  • Required by law

You may terminate your account at any time by deleting the App and canceling your subscription (if applicable).

14. Indemnification

You agree to indemnify, defend, and hold harmless Nicole Kelner LLC DBA Mindful Tech Studio, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit or share through the App

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the new Terms with an updated "Last Updated" date
  • Sending a notification through the App
  • Requiring you to accept updated Terms before continued use

Your continued use of the App after changes constitutes acceptance of the new Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York and the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

17. Apple App Store Terms

If you download the App from the Apple App Store, you acknowledge and agree that:

  • These Terms are between you and us, not Apple
  • Apple has no obligation to provide maintenance or support
  • Apple is not responsible for any product liability claims
  • Apple is a third-party beneficiary of these Terms and may enforce them

18. Additional Terms for European Users

If you are a consumer in the EU/EEA or UK:

  • Nothing in these Terms limits your statutory consumer rights under applicable EU/EEA or UK law, including the Consumer Rights Directive (2011/83/EU).
  • The binding arbitration clause in Section 16 (Governing Law) does not apply to you. You may bring claims in the courts of your country of residence.
  • You have a 14-day right of withdrawal for digital purchases. Since subscriptions are processed through Apple, withdrawal requests should be directed to Apple per their refund policy.
  • These Terms are governed by New York law, but this does not deprive you of the protection of the mandatory consumer protection laws of your country of residence.

19. Additional Terms for Brazilian Users

If you are in Brazil, these Terms are subject to the applicable provisions of the Brazilian Consumer Defense Code (CDC) and the Lei Geral de Proteção de Dados (LGPD). In case of conflict between these Terms and Brazilian law, Brazilian law shall prevail for Brazilian users.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App.
